Introduction

These Terms of Service (“Terms”) govern your use of the DrankShot mobile application (“App”) provided by DrankShot (“we,” “our,” or “us”). By downloading, installing, or using our App, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the App.

App Description and Usage

DrankShot is an AI-powered beverage tracking application that: - Allows users to take photos of alcoholic beverages for identification and analysis - Provides information about drink type, estimated alcohol content, and calories - Optionally tracks location where beverages were consumed - Maintains a history of tracked beverages

User Accounts and Eligibility

• The App is intended for users who are 21 years of age or older.
• You must not use this App if you are under the legal drinking age in your jurisdiction.
• No account creation is required to use the App, as data is stored locally on your device.

Credits and Purchases

• The App provides 10 free drink analyses for new users.
• Additional analyses require in-app purchases:
  • 100 analyses for $1.99
• All purchases are processed through Apple’s App Store and subject to their terms.
• Purchases are non-refundable except as required by applicable law.

Privacy and Data Usage

• Please review our Privacy Policy for information on how we collect, use, and process your data.
• By using the App, you consent to the data practices described in our Privacy Policy.
• We do not sell your personal information to third parties.

License and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

You may not: - Modify, disassemble, decompile or reverse engineer the App - Remove or alter any copyright, trademark or other proprietary notices - Use the App for illegal purposes or to track others’ consumption without consent - Interfere with or disrupt the integrity or performance of the App - Attempt to gain unauthorized access to the App or its related systems

User Content and Conduct

• You are solely responsible for the images you upload to the App.
• You must not upload images containing inappropriate content or content that infringes on others’ rights.
• We reserve the right to terminate access for users who violate these Terms.

Disclaimer of Warranties

• THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
• WE DO NOT GUARANTEE THE ACCURACY OF DRINK ANALYSIS RESULTS.
• THE APP SHOULD NOT BE USED TO DETERMINE SAFE ALCOHOL CONSUMPTION LEVELS OR FITNESS TO DRIVE.
• ANALYSIS RESULTS ARE ESTIMATES ONLY AND SHOULD NOT BE RELIED UPON FOR MEDICAL OR SAFETY DECISIONS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of the App or your violation of these Terms.

Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the “Last Updated” date.

Governing Law

These Terms shall be governed by the laws of the state of California, without regard to its conflict of law provisions.
